On 15 December 2025, the Government of Canada passed Bill C-3 following a December 2023 ruling by the Ontario Superior Court. This led to an important modernization of the Citizenship Act, expanding eligibility beyond the first generation. Under this revised framework, individuals with a Canadian ancestor, including a grandparent, great-grandparent, or earlier generation, may now qualify for citizenship, depending on their lineage and specific circumstances.

Requirements of Canadian Citizenship by Descent

You may qualify for Canadian citizenship by descent if:

  • At least one of your parents was born in Canada; or
  • You were born outside Canada and your parent or ancestor (grandparent, great-grandparent, or earlier generation) was a Canadian citizen at the time of your birth; or
  • You were born outside Canada and your parent later became a Canadian citizen as a result of recent legislative changes

In addition, applicants must be able to demonstrate:

  • A clear genealogical link to a Canadian parent or ancestor
  • That the relevant parent or ancestor held Canadian citizenship status
  • That eligibility falls within the scope of the updated Citizenship Act

Each case is assessed individually, particularly under the expanded rules introduced by Bill C-3.
